How can I qualify for Chapter 7 bankruptcy?

In order to qualify for Chapter 7 bankruptcy, you must pass the means test. In Washington State, that means that a family of four with an annual income under $80,404 (2010 Census Bureau statistics) will easily qualify for Chapter 7. Can I keep my car and my house?

Your house and car are collateralized assets or secured debt. You may usually keep your car if you continue to make monthly payments on time. In Washington State, you may exempt up to $125,000 in equity on your home. If you have fallen behind due to a temporary change, your lender may be willing to renegotiate the terms of your loan, and stay in your own home.

Will I lose prized personal possessions?

Certain assets such as furniture and household appliances usually are exempt from bankruptcy proceedings. If you have valuables such as antiques, fine art or expensive jewelry, they may be turned over to the court trustee for sale.
