Stopping Creditor Harassment

If you owe money to a credit card company or medical clinic, that credit card company or medical clinic has the right to pursue payment for late or outstanding bills. One of the most difficult issues for clients occurs when they are pursued for money they do not have.

As soon as you file for Chapter 7 or Chapter 13, the court orders your creditors to cease all contact with you immediately. The United States Bankruptcy Court itself mails a Notice of Commencement to all of your creditors and interested parties that you are seeking bankruptcy protection under U.S. Code Title 11, Chapter 3, Subchapter IV, § 362. The Court's order, called the automatic stay, is a temporary injunction ordering all of your creditors to stop harassing you immediately.

Creditors are prohibited from contacting you for payment, stopping by your workplace or hassling you by phone. Creditors are given the name and address of the court-appointed bankruptcy trustee and the date, place and time for the meeting of creditors. If creditors wish to pursue a claim, they may present their case to the court at the meeting of creditors.

If creditors violate the automatic stay, which is a federal mandate, the court may fine the creditor, depending on the seriousness of the wrongdoing.
